Terms and conditions
These terms govern your use of the Xitique app. Read them before creating an account — by using the app, you are bound by them.
1. Acceptance
By creating an account or using the Xitique app, you confirm that you have read, understood and accept these Terms and Conditions and the Privacy Policy, which forms part of them. If you disagree with any part, you should not use the app.
2. What Xitique is (and is not)
Xitique is a digital tool for organising and recording rotating savings groups among people who know and trust each other. The app helps you keep track of dues, cycles, contributions and the payout order.
Xitique is not a financial institution. The app does not move money, process payments, hold funds, lend, or provide financial intermediation, investment or insurance services. All money moves directly between group members, outside the app.
3. Account and eligibility
- You must be at least 18 years old to use Xitique.
- The information you provide must be true and kept up to date.
- Each person should have only one personal account.
- You are responsible for keeping your password secret and for all activity carried out from your account.
- Tell us as soon as you suspect unauthorised access to your account.
4. Acceptable use
When using Xitique, you agree not to:
- use the app for unlawful purposes, including pyramid schemes, fraudulent fundraising or money laundering;
- record false information, forged proof of payment or payments you did not make;
- post offensive or defamatory content, or content that infringes the rights of others;
- access groups or data you do not belong to, or attempt to bypass security controls;
- use automated systems to extract data from the app;
- resell, sublicense or commercially exploit the app without written permission.
5. Groups and responsibility between members
A xitique group is a private agreement between its members. Xitique is not a party to that agreement, does not guarantee it and does not mediate disputes.
- The group creator sets the contribution amount, the frequency and the initial rules.
- The payout order is decided by the group, by draw or by agreement between members.
- If a member fails to contribute, is not paid, or leaves the group, resolving it is up to the group. The app only records what happened.
- Invite only people you know. Anyone holding the group's invite code or QR code can join it.
6. Contributions and payments
- Transfers happen outside the app, via M-Pesa, e-Mola, bank transfer, cash or any other means the group chooses.
- Marking a contribution as paid is your declaration that you made the payment. The attached proof is the evidence you present to the group.
- We do not check, confirm or guarantee that any payment recorded in the app actually took place.
- We are not responsible for amounts left unpaid, overpaid, paid to the wrong person or lost through operator failures.
7. Content you submit
You keep ownership of everything you upload — photos, proof of payment and notes. You grant us only the technical permission needed to store and display that content in the app, to the members of the groups you belong to, for the purpose of running the service.
You are responsible for the content you submit. Do not upload other people's documents or sensitive information that should not be seen by the rest of the group. We may remove content that breaches these Terms or the law.
8. Service availability
We aim to keep Xitique available and working, but the service is provided "as is", without guarantees of continuous availability, freedom from errors or fitness for a particular purpose. We may change, suspend or discontinue features. If we discontinue the service, we will give reasonable notice so you can export your group information.
9. Price
The app is currently free and contains no advertising and no in-app purchases. If paid features are introduced, they will be announced clearly and never activated without your express consent.
10. Intellectual property
The app, the Xitique name, the logo, the design and the code belong to their owners and are protected by law. These Terms transfer no rights over them to you, beyond the right to use the app while you comply with these conditions.
11. Privacy
How we handle your personal data is described in the Privacy Policy. You can delete your account at any time — see Delete account and data.
12. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for:
- default, delay or fraud by members of your group;
- financial losses arising from agreements made between members;
- failures of payment operators, banks or mobile networks;
- data loss caused by device failure, uninstalling the app or losing your credentials;
- indirect damages, lost profits or lost opportunity.
Nothing in these Terms excludes liability that the law does not allow to be excluded, including in cases of wilful misconduct, and nothing affects the rights consumer law gives you.
13. Suspension and termination
We may suspend or close accounts used fraudulently, in breach of these Terms, or that put other users at risk. Wherever possible we will warn you first and state the reason.
You can close your account whenever you want, from the app or by written request — see Delete account and data. Closing your account does not cancel commitments you have made to the members of your groups.
14. Changes to these terms
These Terms may be updated for legal, technical or operational reasons. The date at the top shows the version in force. Material changes will be announced in the app, and continuing to use it after that announcement means you accept the new version.
15. Governing law
These Terms are governed by the law of the Republic of Mozambique. Any dispute will be submitted to the competent courts of the City of Maputo, without prejudice to the rights consumer law gives you. If any clause is found to be invalid, the remainder stays in force.
